I was having same issue, i went to Nvidia support thought that it must be because Nvidia graphics card and got this response from them. I.e Due to architectural changes in the new Windows Vista Window Display Driver Model (WDDM), the graphics driver can no longer disable vsync from its own driver or Control Panel. Selecting this option from the NVIDIA Control Panel will have no affect on DirectX applications. For applications that use Direct3D on Vista, use the vertical sync setting within the application.

I've tried forcing vsync in a number of games and I can confirm that it has no effect. One thing that I would warn you about is that sometime turning Vsync off causes what is called "tearing". This is when the screens draws are not timed as they should be and causes some issues with the middle of bottom of the screens. If this happens, then going back in and turning vsync back on is the only way to correct the tearing issue. If you don't want to change your refresh rate, just turn off vsync.
