Battery replacement MacBook Pro REFUSED!Despite meets requirements.

Here is a brief explanation of my problem:

    February 2007 bought a MacBook Pro 2.16 C2D
All was fine for the first attach.
About three months ago, the computer that had a battery does not go to sleep at the end of charge, but turns off suddenly.
From that moment I do not think we went to sleep more for low battery, it was always off. even more serious: THE BATTERY CAPACITY TO LOSE ANY STAGE and in the space of two months has fallen almost 50%.
I try to put on the internet and in the end what I find is this..
MacBook and MacBook Pro - Battery Update 1.2 Required

Having said that I go at the Apple center with the purchase invoice and everything. I answered first that there is no program of this kind, then once shown the document it says to try elsewhere.I call customer service, tell me that my computer is not under warranty, and we knew this already. But the document said there is no question of precisely extended warranties:

"Apple has recently discovered that some batteries used in notebook MacBook and MacBook Pro with performance problems. Is then made available to users with a software update that eliminates these malfunctions. (Obviously done ....)
This update of the battery must be made for all MacBook and MacBook Pro and also for the extra batteries purchased between February 2006 and April 2007. "
The batteries involved with one or more of the following symptoms:
    • The battery is not recognized because it "X" in Icon of the battery icon in the Finder menu.
    • The battery does not charge when the computer is connected to AC power.
    • The battery fully charged presents low capacity of charge / operating in the event of counting cycle of the battery (shown in Determination of the count of battery cycles) of less than 300.
    • The battery appears visibly deformed.

My macbook is a "system MacBook Pro with Intel Core Duo processor" or that is core 2 duo does not make it eligible for replacement?

I would remind you that the C2D came out in late October 2006, so it's obvious that I was eligible because of Apple doc says:
"This battery update should be made for all MacBook and MacBook Pro and also for the extra batteries purchased between February 2006 and April 2007."

So in all this, what should you do?

Just the whole procedure that is linked to the Core Duo, while your own is a Core 2 Duo.. models are different.
I think we had a serial number to verify if the battery was part of that round, however flawed...
Computer Model: MacBook Pro (15 ")
    A1175 Model Number Battery: A1175
    Serial numbers range of battery:
    U7SA end, U7SB or U7SC
