Have you made sure that you are having the proper requirement for the game, if yes then just check out the log that will be in the below link:
    ProgramData\Battle.net\Agent\Agent.440\Logs\Agent.log file
Just check it out and see if you are able to find out anything to be suspicious, if you want then you can post the same here so I can have a better idea of the issue that you are facing and will try to help you with the same, just check it out and then let me know the same for further help.

I think that there might be some program that it messing up the installation process, so just to be at the safer side make sure that you are not running any other program in the background rather than just the installed and see if it is making any difference, other than this also make sure that you are disabling the antivirus and other such program for that moment, just try it out and the let me know the response that you get for this solution.

I have been facing the same issue to explain the same in short:
    1. Open installer
    2. Accept Terms and Agreements
    3. The above error comes up and then there is no progress in the installation
    4. After sending report it says unavailable

This is what I have been doing and for several times but then I have got the same response, is there anyone who can help me out as well????

I was facing the same issue but then later I found that my network setting was network setting in order to get better internet speed but then after changing the same to default I started the installation process and had unlocked the D3 download and made sure that I am running the same as admin, below are things that one had follow:
    1. First Download Diablo-III-Beta-enUS-Setup
    2. After that Download Diablo-III-Beta-enUS-Setup
    3. Then check out the compatibility run program
    4. Last thing is to change the network setting.
