Yes, it can be played in DirectX 10 mode.
Tom Clancy's HAWX aligns itself with the other games that support DirectX 10. With the Vista API the following additional graphics effects that are not available under DirectX 9:

Yeah this game supports DX10, you run it from a DX10 exe file. Though the game has some performance issues in DX10. And honestly ive never noticed any major difference between DX9 and DX10 in this game unless you put two different screenshots side by side.
In the graphics options, it tells you instructions on how to make it in DX10 mode... at the bottom of the screen in Graphics Settings.
I don't understand the instructions though. BUT! They DO give DX10.
