PSP: Customs firmware, downgrade, homebrew and legality

The Downgrade (change the firmware version by a lower)

Sony does not downgrade of the console, from the time an update is installed, you can not revert to a previous version of firmware it is mentioned that you waive your rights to use an older version system software.

The downgrade is done mostly to run games (or other programs) pirated.
It is important to emphasize that if this is poorly made, it can cause blockage of the PSP ™ and render inoperative, and in this case the security is no longer valid.

To the extent permitted by applicable law, the rights that you have and enabling you to use the current version of the software system or access extinguished when installing a newer version of System Software on your PSP™, that the installation is carried out using a download manual or automatic realizes that SCE by an online network of SCE or is effected otherwise.

    PSP: Customs firmware

The custom firmware (firmware modified by independent programmers)

Sony prohibits the use, the Sony official firmwares have protections preventing the installation of games (or applications) unsigned or pirated.
The Customs Firmwares are created just to run these games or applications, thus blowing protections installed by Sony.

You should know that the installation of these firmware is risky, because besides the fact that the guarantee is canceled, this can result blocking the PSP ™ and render it ineffective.

You are not allowed to lease, to rent, license, publish, modify, adapt or translate any part of the Software System. In the fullest extent permitted by law, you are not authorized to make the retro-design, decompilation or disassembling any portion of the Software System or create derivative works from, or still trying to establish the source code of the Software System from its object code.

    PSP:homebrew

The Homebrew (software developed by independent programmers)

Sony does not install these programs, over to run a homebrew on the PSP ™ must install a custom firmware or make a downgrade to a lack of protections, which amounts to crack the console.

It is important to know that if the PSP ™ malfunction following the installation of a homebrew, your console is no longer guaranteed.

You can not (i) use the software, hardware or
unauthorized software, illegal, forged or altered, provided that these items
includes tools to bypass, disable or circumvent any
encryption mechanism, security or authentication to protect the PSP ™ [..]
(iii) use a hardware or software to ensure that the Software System
    accepts or uses a software or hardware unauthorized, illegal or pirated;
