The amd phenom ii x4 810 will give you more advantage in the future but the Q9400 is the better CPU of the two. Personally I would go with an AMD 810, its worth the extra $50. Q9400 will easily hit 4Ghz on air and 4.5GHz on water. These CPUs only partially support their stated 1,333MHz memory.
AMD Phenom II X4 810 is better than intel q9400. 810 is Available in PIB at AMD's( So 810 is actually 910 that operates at same 2.6GHz ) with TDP : 95W, Frequency : 2.6 GHz, L2 Cache : 2MB, L3 Cache : 4MB. Phenom II X4 810 processors can benefit from the use of DDR3 memory and meet another quad-core CPU from the company that stands for maximizing price-to-performance ratio.
AMD Phenom II X4 810 2.6GHz 4 x 512KB L2 Cache 4MB L3 Cache Socket AM3 95W Quad-Core Processor with a universal dual-channel memory controller supporting both DDR2 (up to DDR2-1066) and DDR3 (up to DDR3-1333) memory and Intel Core 2 Quad Processor Q9400 (6M Cache, 2.66 GHz, 1333 MHz FSB) : have PROCHOT# enabled, THERMTRIP# enabled , PECI enabled ,Extended Stop Grant State (C2E) enabled.
